Illegal detention of children is condamned by the Council of State

In 2016, the Belgian State reminded the Immigration Office that it was illegal to detain a member of a family with minor children. Indeed, the Royal Decree arrest wasn’t clear about this point. The Council of State thinks that the detention of a single member is a disrespect of the Belgian Constitution and of the European Convention for Human Rights. Another point condemned by NGO was the prohibition of detention of children because of their migrator / stay status such as written in the Convention for children rights. The Immigration Office was attacked again by NGO to avoid the closure of 10.000 places in welcoming centers. If those were actually closed, only 24.000 places would be left whereas 28.000 are now occupied.
